Jay's Incomparable Live CD is not contract bound

by kelvin@multistars - 8th December 2004

Jay and Sony's publishing contract dispute has still not been sorted, Jay's "Incomparable" concert live CD has been estimated to be released on the 21st, the thing that has made the world of records surprised is that Alfa Music, the company Jay belongs to, has quickly let Warner Music, who have such artists as Stef Sun, publish this concert album.

When "Alfa Music" general manager Mr Yeung, who is in Thailand with Jay filming a commercial, received our call asking for confirmation, he said: "Yes, Jay's Taipei "Incomparable" concert live CD has indeed been given to Warner Music to publish!"

Mr Yeung said that Jay and Sony Music's contract originally expires next year, but, Sony Music delayed payments and the overseas sales reports were not clear, at the end of October, "Alfa Music" publicly announced that the collaboration between the two sides have been discontinued. "At that time, I said that there was not much room to work with Sony in the future, I didn't rule out that we might collaborate with a more sincere international record companies." Giving Jay's "Incomparable" concert live album to Warner Music to publish, "It was negotiated by me and Warner Music's Regional Director of Greater China Zhou Jian Hui, but, we only signed with Warner for one album."

Will this move spark a copyrights battle between the two big international companies Sony and Warner? "No." Mr Yeung explained that they have already hired a lawyer to look at the contract, the "version" Jay sang at the concert is a live version and is different from the album "versions" Sony has published in the past so it is not contract bound.

Will Sony protest? "They probably will, I have already asked Holiday Group to deal with this part." Mr Yeung said. Sony Music's Regional Director of Greater China Cui Zhen Dong said: "We already know that Jay's concert album has been given to Warner to publish, as to how Sony will handle this, it has implications to legal issues, at the moment it is still inconvenient to talk about it."

Originally Jay released one album a year, who could have thought after releasing "Common Jasmin Orange" in August, he would be releasing "Incomparable" concert live version in December, it can be considered as another kind of best selections, to Warner Music, who managed to get the publishing rights, the results of business will be very "filling", but this record battle at the end of the year, originally it was the fight between these two creative geniuses David Tao and Leehom Wang, Jay has stuck his foot in, it will be even more lively.
